Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Diminos (the “App”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our End User License Agreement. If you do not agree, do not use the App. You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Diminos.

2. Use of the App

You agree to use Diminos only for lawful purposes and in accordance with these Terms. You may not:

• Reverse-engineer, decompile, or modify the App
• Use the App for any commercial purpose without permission
• Attempt to exploit bugs, glitches, or vulnerabilities
• Use bots, scripts, automation tools, modified clients, or third-party cheating software
• Share, sell, or transfer your account to another person
• Use multiple accounts to manipulate leaderboards or game features
• Harass, threaten, or harm other users
• Use offensive or inappropriate display names

We reserve the right to monitor and moderate display names, leaderboard entries, and user-created content. We may remove content or restrict access at our discretion without notice.

3. Accounts

If you create an account, you are responsible for maintaining the security of your login credentials. You are responsible for all activity under your account. Notify us immediately at support@diminos.app if you suspect unauthorized access.

4. In-App Purchases & Virtual Items

Diminos may offer in-app purchases including cosmetic items, Season Pass, and VIP membership. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective refund policies. Unless required by applicable law, all purchases are final and non-refundable.

All virtual items, cosmetics, currencies, and other digital content within Diminos are licensed to you, not sold. You do not own virtual items. Virtual items have no real-world monetary value and cannot be exchanged for cash, traded, sold, or transferred outside the App. We reserve the right to modify, remove, or rebalance virtual items at any time.

5. Subscriptions

Season Pass and VIP memberships are auto-renewing subscriptions. By purchasing a subscription, you authorize recurring charges at the then-current price until you cancel. Subscriptions are managed and billed through your Apple App Store or Google Play Store account.

• To cancel, go to your subscription settings in the App Store or Google Play Store
• Cancellation takes effect at the end of the current billing period
• You retain access to subscription benefits until the end of your paid period
• Deleting the App does not cancel your subscription

6. Intellectual Property

All content in Diminos, including but not limited to graphics, gameplay mechanics, sounds, music, text, and software, is owned by Gridley Studio LLC and protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works without our prior written permission.

7. Game Modifications

We reserve the right to modify, update, suspend, or discontinue the App or any features, content, or services (including purchased items and subscription benefits) at any time, with or without notice, and without liability to you. This includes the right to add, change, or remove game levels, modes, anomalies, cosmetic items, and other content.

8. Disclaimer of Warranties

Diminos is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or free of harmful components. We make no warranty regarding virtual items, subscription availability, or server uptime.

9. Limitation of Liability

To the fullest extent permitted by law, Gridley Studio LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total cumulative liability to you for any and all claims shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless [Company Name, LLC] and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

11. Dispute Resolution & Arbitration

Any dispute arising from or relating to these Terms or the App shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and Gridley Studio LLC each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding.

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction. You may opt out of this arbitration provision by sending written notice to support@diminos.app within 30 days of first accepting these Terms.

12. Termination

We reserve the right to suspend or terminate your access to Diminos at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your license to use the App ends, and you lose access to your account, virtual items, and subscription benefits. No refunds will be issued for unused virtual items or remaining subscription time upon termination for cause.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the revised Terms. The “Last updated” date at the top indicates when these Terms were last revised.

15. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and Gridley Studio LLC regarding the App. Our failure to enforce any right or provision shall not be considered a waiver of that right or provision. Neither party shall be liable for any failure or delay caused by circumstances beyond their reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, internet or power outages, or third-party service failures.
